Scope of This Policy

Exovian Developments LLC (“Exovian,” “we,” “our,” or “us”), a limited liability company organized under the laws of the State of Wyoming, USA, develops and operates mobile applications, web applications, software development kits (SDKs), and related digital services. This Privacy Policy (“Policy”) describes how we collect, use, disclose, and otherwise process personal information related to:

  • Visitors of our websites, including exovian.dev;
  • Individuals who download and use any of our mobile or web applications;
  • Individuals who subscribe to receive communications, newsletters, or marketing materials from us;
  • Current, former, and prospective customers, vendors, and business partners; and
  • Individuals who otherwise interact or engage with us or our services (collectively, the “Services”).

By using our Services, you agree that your personal information will be handled as described in this Policy. If you do not agree with the terms of this Policy, please do not access or use the Services.

1. Personal Information We Collect

Information You Provide Directly. The personal information we collect varies depending on your use of our Services and your interactions with us. In general, we may collect:

  • Contact Information: Name, email address, phone number, and any other information you provide through contact forms or account creation.
  • Account Information: Credentials, profile information, and preferences associated with your account.
  • Communications: Records of your contact details, communications with us, feedback, and our responses.
  • User-Generated Content: Any data, text, or content you voluntarily input, submit, or create within our applications.

Information Collected Automatically. We and our service providers may automatically collect information related to your use of our Services, including:

  • Device and Browsing Information: IP address, browser type, operating system, device type, unique device identifiers, language preferences, and similar technical information.
  • Usage Data: Information about how you interact with our Services, including features used, actions taken, time spent, and navigation patterns.
  • Performance Data: Crash reports, error logs, and application performance metrics used to maintain and improve our Services.

AI-Processed Data. Some of our applications use artificial intelligence and machine learning to provide personalized experiences. When applicable, data processed by AI may include:

  • Text inputs and interactions within the application;
  • User-generated data used to generate personalized content, recommendations, or strategies; and
  • Behavioral patterns used for adaptive features and notifications.

2. How We Use Personal Information

We use the personal information we collect for the following purposes:

  • Services and Support: To provide, operate, maintain, and improve our Services; to communicate with you about your use of the Services; and to provide technical support and respond to inquiries.
  • Personalization: To personalize your experience, deliver adaptive content, and provide features tailored to your preferences and usage patterns.
  • Analytics and Improvement: To understand how users access and use our Services, evaluate and improve our offerings, and conduct internal research and development.
  • Communications: To send you requested information, service updates, administrative notices, and, with your consent, marketing and promotional materials.
  • Security and Protection: To protect the Services and our business operations; to detect, prevent, and address fraud, unauthorized access, and other misuse; and to protect the rights, property, and safety of Exovian and our users.
  • Legal Compliance: To comply with applicable legal or regulatory obligations, respond to legal process, and enforce our terms and policies.

3. How We Disclose Personal Information

We do not sell, trade, or rent your personal information. We may disclose information in the following circumstances:

  • Service Providers: To trusted third-party vendors and service providers who perform functions on our behalf (such as cloud hosting, analytics, payment processing, and AI/LLM processing), subject to confidentiality obligations.
  • AI Processing: Anonymized or pseudonymized data may be processed by third-party AI providers. We minimize personally identifiable information shared with these providers.
  • Business Transfers: In connection with a merger, acquisition, reorganization, or sale of assets, your information may be transferred as part of that transaction.
  • Legal Requirements: When required by law, regulation, legal process, or governmental request.
  • Security and Protection of Rights: Where we believe it is necessary to protect the Services, our rights, or the rights, property, and safety of others.
  • Aggregate and De-identified Information: We may use and disclose aggregate or de-identified information that cannot reasonably be used to identify you, for analytics, research, and other purposes.

4. Data Storage and Security

We implement appropriate technical and organizational security measures designed to protect your personal information against unauthorized access, alteration, disclosure, or destruction. Your data is stored on secure cloud infrastructure with encryption at rest and in transit.

While we strive to use commercially acceptable means to protect your data, no method of transmission over the Internet or method of electronic storage is 100% secure. We cannot guarantee absolute security.

5. Your Rights and Choices

Depending on your location, you may have the following rights regarding your personal information:

  • Access: Request a copy of the personal data we hold about you.
  • Correction: Request correction of inaccurate or incomplete data.
  • Deletion: Request deletion of your personal data, subject to legal exceptions.
  • Data Portability: Request a copy of your data in a structured, machine-readable format.
  • Opt-Out: Opt out of marketing communications at any time.
  • Notification Preferences: Manage push notification settings through your device settings. Disabling certain notifications may affect the functionality of some Services.

Account and Data Deletion Process

To request the deletion of your account and all associated personal data, please send an email to deletion@exovian.dev. Please include your full name and the email address associated with your account.

Upon receiving a verified deletion request:

  • We will acknowledge your request within 7 business days.
  • Data deletion will be completed within 30 calendar days from the date of verification.
  • You will receive a confirmation email once the process is complete.

Data that will be deleted:

  • All user-generated content, including text, inputs, configurations, and preferences;
  • Profile information such as name, display name, and user preferences;
  • Usage patterns, behavioral data, and activity history;
  • AI-processed data, personalized models, and recommendations;
  • Device information and browsing data associated with your account; and
  • Notification preferences and application settings.

Data retained for legal and compliance purposes:

In accordance with applicable tax, accounting, and regulatory requirements, the following data is retained for up to seven (7) years after account deletion:

  • Transaction and payment records: Purchase history, billing information, and payment confirmations, as required by U.S. tax law (IRS) and payment card industry regulations.
  • Anonymized user identifier: A hashed, non-reversible version of your account ID linked solely to retained transaction records for audit trail integrity.
  • Account lifecycle dates: Date of account creation and date of deletion, for regulatory compliance and audit purposes.
  • Legal and compliance records: Any communications related to disputes, legal processes, or regulatory inquiries involving your account.

Retained data is stored securely with restricted access and is used exclusively for legal, tax, audit, and fraud prevention purposes. It is not used for marketing, analytics, or product development.

6. Cookies and Tracking Technologies

Our websites and Services may use cookies, pixel tags, and similar tracking technologies to automatically collect information about browsing activity and usage. We use this information to analyze how users interact with our Services, to improve performance, and to personalize content. You can manage your cookie preferences through your browser settings. Disabling cookies may affect the functionality of certain features.

7. Health and Wellness Disclaimer

Some of our products may provide behavioral coaching, habit-tracking, or wellness-related features powered by AI. These features are designed for general wellness purposes only and are not intended to diagnose, treat, cure, or prevent any medical or mental health condition. Our products do not replace professional medical advice, diagnosis, or treatment. Users should consult with qualified healthcare professionals before making health-related decisions.

8. Children’s Privacy

Our Services are not designed for or directed to children under the age of 13 (or the applicable minimum age in your jurisdiction). We do not knowingly collect personal information from children. If we become aware that a child has provided us with personal information, we will take steps to promptly delete such information. Parents or guardians who believe their child has provided information to us should contact us immediately at privacy@exovian.dev.

9. International Data Transfers

Your information may be transferred to and processed in countries other than your country of residence, including the United States and Costa Rica, where our servers and service providers may be located. These jurisdictions may have different data protection laws than your home country. By using our Services, you consent to such transfers. We implement appropriate safeguards to protect your data during international transfers.

10. Data Retention

We retain your personal data for as long as your account is active or as needed to provide our Services. Upon account deletion, all user-generated content and personal data is permanently removed in accordance with the deletion process described in Section 5 above.

Certain records are retained after account deletion solely for legal and compliance purposes, including transaction and payment records, anonymized user identifiers, account lifecycle dates, and legal correspondence. These records are retained for up to seven (7) years, as required by applicable tax, accounting, and regulatory obligations. See Section 5 for the complete list of retained data categories.

When retained data is no longer needed for its stated purpose, we securely delete or irreversibly anonymize it.

11. Third-Party Links and Services

Our Services may contain links to third-party websites, applications, or services. Access to and use of such linked services is not governed by this Policy but by the privacy policies of those third parties. We are not responsible for the information practices of external services. We encourage you to review the privacy policies of any third-party services before providing your information.

12. Changes to This Privacy Policy

We may update this Privacy Policy from time to time. We will notify you of material changes by:

  • Updating the “Last updated” date at the top of this Policy;
  • Posting a prominent notice on our website or within our applications; and
  • Sending you a notification, where applicable.

Your continued use of our Services following the posting of changes constitutes your acceptance of the updated Policy.

13. App Store Compliance

For applications distributed through the Google Play Store and Apple App Store, this Privacy Policy complies with their respective requirements:

  • Google Play: Our apps comply with Google Play’s User Data policy, including requirements for a privacy policy, secure data handling, prominent disclosure of data collection, and the Data Safety section requirements.
  • Apple App Store: Our apps comply with Apple’s App Store Review Guidelines regarding user privacy, data collection transparency, App Privacy nutrition labels, and App Tracking Transparency requirements.
  • Huawei AppGallery: Our apps comply with Huawei’s AppGallery Review Guidelines and privacy requirements, including data collection disclosure, user consent mechanisms, and the AppGallery Connect privacy statement declarations.

Our applications may request access to the following device permissions in order to enable specific features and functionalities. Without granting these permissions, the associated functionality may be limited or unavailable. It is always the user’s decision whether to grant each permission:

  • Notifications: To deliver timely alerts, reminders, and personalized messages relevant to your use of the application.
  • Camera: To capture photos, scan documents, or enable visual input features within the application.
  • Contacts: To facilitate sharing, invitations, or contact-based features where applicable.
  • Location: To provide location-aware features, content, or recommendations based on your geographic context.
  • Microphone: To enable voice input, audio recording, or speech-based interaction features.

Users can manage or revoke app permissions at any time through their device settings. Revoking a permission will disable only the features that depend on it; all other application functionality will continue to operate normally.

App Tracking Transparency (Apple iOS)

Our applications do not track user activity across other companies’ apps or websites. We do not use the Identifier for Advertisers (IDFA) or any cross-app tracking technologies. As such, our applications do not trigger Apple’s App Tracking Transparency (ATT) prompt. All analytics and data processing occur exclusively within the context of our own Services.

14. California Privacy Rights (CCPA/CPRA)

This section provides additional information for California residents pursuant to the California Consumer Privacy Act of 2018, as amended by the California Privacy Rights Act of 2020 (collectively, the “CCPA”). This section applies to “personal information” as defined under the CCPA and does not apply to publicly available information or de-identified or aggregated information.

Categories of Personal Information Collected. In the preceding 12 months, we may have collected the following categories of personal information, as defined by the CCPA:

  • Identifiers: Such as name, email address, phone number, unique personal identifier, online identifier, IP address, and account name.
  • Customer Records: Account and profile information, contact information, account credentials, and communications preferences.
  • Commercial Information: Records of products or services purchased, obtained, or considered.
  • Internet or Electronic Network Activity: Browsing history, search history, and information regarding interactions with our websites, applications, or services, including usage data.
  • Geolocation Data: Approximate location information derived from your IP address.
  • Inferences: Inferences drawn from the information above reflecting preferences, characteristics, behaviors, or attitudes.

Your CCPA Rights. As a California resident, you have the following rights with respect to your personal information:

  • Right to Know/Access: You have the right to request the categories and specific pieces of personal information we have collected about you, the categories of sources, our business purposes for collecting the information, and the categories of third parties with whom we have shared it.
  • Right to Correct: You have the right to request that we correct inaccuracies in your personal information.
  • Right to Delete: Subject to certain exceptions, you have the right to request that we delete personal information we have collected from you.
  • Right to Opt-Out of Sales and Sharing: You have the right to opt out of the “sale” or “sharing” of your personal information as defined under the CCPA. We do not sell personal information in the traditional sense (i.e., for monetary consideration).   • Right to Limit Use of Sensitive Personal Information: We do not engage in uses or disclosures of “sensitive personal information” that would trigger this right under the CCPA.
  • Right to Non-Discrimination: We will not discriminate against you for exercising any of your CCPA rights.

Before responding to your request, we will verify your identity using the personal information you have previously provided to us. We will respond to verifiable requests within 45 days. You may also designate an authorized agent to submit requests on your behalf; authorized agents will be required to provide proof of authorization.

Retention. We retain personal information for as long as needed based on the reason we obtained it, consistent with applicable law. Rather than delete your personal information, we may also de-identify it in compliance with the CCPA.

15. European Privacy Rights (GDPR)

This section provides additional information for individuals located in the European Economic Area (EEA), United Kingdom (UK), or Switzerland. If you are located in one of these jurisdictions, you have specific rights under the General Data Protection Regulation (GDPR) and equivalent legislation.

Legal Bases for Processing. We process personal information on the following legal bases:

  • Consent: Where you have given us explicit consent to process your personal information for a specific purpose.
  • Performance of a Contract: Where processing is necessary to fulfill our obligations under a contract with you (e.g., providing our Services).
  • Legitimate Interests: Where processing is necessary for our legitimate business interests, provided those interests do not override your fundamental rights and freedoms.
  • Legal Obligation: Where processing is necessary to comply with a legal obligation to which we are subject.

Your Rights. Under GDPR, you have the following rights:

  • Right of Access: You have the right to obtain a copy of your personal information.
  • Right to Rectification: You have the right to request correction of inaccurate or incomplete information.
  • Right to Erasure: Under certain conditions, you have the right to request deletion of your personal information.
  • Right to Restrict Processing: Under certain conditions, you have the right to restrict the processing of your personal information.
  • Right to Data Portability: Under certain conditions, you have the right to receive your personal information in a structured, commonly used, and machine-readable format.
  • Right to Object: You have the right to object to the processing of your personal information in certain circumstances, including processing based on legitimate interests and processing for direct marketing purposes.
  • Right to Lodge a Complaint: You have the right to lodge a complaint with the supervisory authority in your jurisdiction.

International Transfers. We are based in the United States. If you are located in the EEA, UK, or Switzerland, your personal information will be transferred to and processed in the United States and potentially other jurisdictions. Data protection laws in these countries may differ from those of your country of residence. We implement appropriate safeguards, including standard contractual clauses where applicable, to protect your data during such transfers.
